As observed in the previous order, none had made appearance on behalf of the respondents, despite service. Even, today none has made appearance on behalf of the respondents. As such, the respondents are proceeded against ex parte.

TA-36-2024 and connected case -2These are two transfer applications, filed at the instance of applicant-wife, for seeking transfer of the petition under Section 9 of the Hindu Marriage Act, bearing No.HMA-80-2022, and petition under Section 25 of the Guardians and Wards Act, both filed by the respondent-husband, titled 'Satinder Singh vs. Daljit Kaur'. Both the aforesaid cases are pending in the Family Court, Samana, District Patiala and she seeks transfer of the same to the Court of competent jurisdiction at Garhshankar, District Hoshiarpur.
At the very outset, it is submitted by learned counsel for the applicant that two children were born from the wedlock of the parties, i.e. one daughter aged 12 years and one son aged 8 years. Both the said children are in the care and custody of the applicant. On account of the matrimonial dispute, the applicant has also filed petition under Sections 12, 15, 17, 18, 19, 20 and 22 of the Protection of Women from Domestic Violence Act, which is pending in the Courts at Hoshiarpur and the respondent is making appearance in the same. The applicant is not having any source of earnings. The distance between the places is about 160 kms.
In view of the submissions aforesaid, it is pertinent to mention that the applicant is taking care of both the children, born from the said wedlock of the parties, more particularly, while she herself is not having source of earning. Even, the respondent, as such, has not come forward to resist the transfer application. Moreover, other litigation arising from the matrimonial dispute, is already pending in the Courts at Garhshankar, District Hoshiarpur and the respondent is making appearance in the same.
TA-36-2024 and connected case -3both the transfer applications. As such, both the transfer applications are hereby allowed and the petition under Section 9 of the Hindu Marriage Act, bearing No.HMA-80-2022, and petition under Section 25 of the Guardians and Wards Act, titled 'Satinder Singh vs. Daljit Kaur', stands transferred from the Family Court, Samana, to the Court of competent jurisdiction at District Hoshiarpur. The requisite record of the aforesaid case be sent by the Family Court, Samana to the District and Sessions Judge, Hoshiarpur. Learned District and Sessions Judge, Hoshiarpur shall assign the said petition to the Family Court (Camp Court), Garhshankar. Even, the parties are directed to appear before the Family Court (Camp Court), Garhshankar, within a period of one month from today onwards.
