AARADHNA SAWHNEY, J (ORAL) Petitioner, an accused in case FIR No.200 dated 23.04.2025 under Sections 61,340,336(3),336(2) and 318(4) of BNS registered at P.S Sector 58, Faridabad, has prayed for grant of regular bail. Relevant facts as emerging from documents on record be noticed hereinbelow:- Jitendra Sharma, set the criminal law in motion by filing a complaint pointing therein that Monika Sharma (P) in conspiracy with other accused namely Priyanka, Manoj Sharma, Shubham Tiwari and Krishan etc have played a calculated fraud on him in the name of getting his daughter admitted in MBBS course. In brief, allegations levelled by the complainant is that his daughter had appeared in NEET Examination. After the result was declared on 04.06.

Complainant further alleged that through Shubham Tiwari, he came in contact with other accused. The entire deal was struck at Rs.15 lacs.

them on different dates. Accused persons presented before him a fake list of selected candidates, wherein name of his (C's) daughter was mentioned at Sr.No.15. An admission information booklet was also handed over to him. By forging signatures of Dr. Sanjay Mishra, it was further assured that the documents of his daughter have been verified. In fact, when the real admission process started in ESIC Medical College & Hospital, Faridabad, he contacted the accused persons who again assured that the girl would secure a seat in the College, but his daughter's name did not figure in the official admission list. Initially, when contacted, they kept on delaying the matter on one pretext or the other but later flatly refused. Prima facie with this backdrop, criminal proceedings were initiated by way of aforesaid FIR.

Bail application filed by the petitioner was dismissed on 03.10.2025 by learned Addl. Sessions Judge, Faridabad. Aggrieved of which, she filed the present petition, seeking similar relief. Based on the compromise arrived at between them, concession of interim regular bail was granted to the petitioner by this Court vide order dated 27.10.2025.

Today, a connected petition bearing CRM-M-58587-2025 seeking quashing of the FIR is also listed before this Court wherein based on compromise arrived at between the parties, the matter has been referred to learned trial Judge for recording the statements of the concerned parties. Mr. M.S. Bhullar, Advocate appearing for the complainant has endorsed the factum of compromise.

Status report filed by way of affidavit of Vivek Kundu, Mujeser, Faridabad on behalf of respondent-State in Court today is taken on record. In para 4 of the report, it has been stated that though four persons were arrayed as accused in the FIR including one Shubham Tiwari but after investigation, challan was filed only against three, namely, Monica (P), Krishna and Priyanka. State counsel does not dispute the factum of compromise.

In view thereof, without expressing any opinion on the merits of the case, concession of interim bail granted to the petitioner vide order dated 27.10.2025 is confirmed subject to her furnishing fresh bail/surety bonds to the satisfaction of trial Court/Duty Magistrate concerned, who may impose any other condition, as deemed appropriate while releasing the petitioner. The present petition accordingly stands allowed. It is made abundantly clear that in case there is any breach of any of the conditions so imposed, the State/complainant shall be at liberty to seek cancellation of bail as granted to the petitioner by this order.
