The petitioner seeks grant of interim bail in respect of a case registered vide FIR No.459, dated 24.09.2018, Police Station Kharkhoda, District Sonipat, under Sections 148, 149, 302 of IPC and Section 25 of Arms Act (Sections, 34, 202, 212 IPC and Section 27 of Arms Act added later on), so as to participate in the marriage of his two real sisters which is scheduled to be solemnized on 02.12.2024.

Pursuant to issuance of notice of motion on 28.11.2024 learned State counsel has verified the factum about the marriage of sisters of the petitioner namely Tanu and Anu which has been found to be correct and the marriage is stated to be solemnized on 02.12.2024.

It goes without saying that the petitioner being brother would be required to perform certain ceremonies in connection with marriage of his sisters. As such the application is allowed to the limited extent that the petitioner is permitted to attend the marriage of his sisters, which is to be solemnized on 02.12.2024, while in custody.

The Superintendent, District Jail, Sonipat shall do the needful for taking the petitioner while in custody to the venue of marriage of his sisters i.e. Village Nathupur, District Sonipat by 10:00 AM on 02.12.2024 till 06.00 PM and consign him back in the jail on the evening of 02.12.2024 itself. 5.

The aforesaid order shall, however, be subject to the condition that family of the petitioner/petitioner deposits the requisite expenses in advance, which are to be incurred for taking the petitioner to the venue of the said ceremony and to consign him back in jail. It is however, made clear that in case the police officials accompanying the petitoner find that there is any development leading to apprehension or any threat to security, they may get the petitioner back even before 06:00 PM from the venue so as to consign him back to jail on the same day.

The police officials entering the venue can wear the civil uniform. However, police officials in uniform, if any, accompanying shall remain outside the venue.
