Learned Senior Counsel submits that there is loss caused by the petitioner to the exchequer on account of less wheat, for which Annexure P-4 is referred to that the charge was not given to him with regard to the same, he was working as a helper, besides one co-accused Farid Khan has been granted interim anticipatory bail on 12.10.2023, which was confirmed on 19.10.2023, Annexure P-9. The petitioner retired on 30.11.2019 and is getting pension meaning thereby there are no disciplinary proceedings against him. The very fact that for 10 long years, the petitioner has not been required by the investigating agency, is in itself a good ground to grant interim anticipatory bail, as in SLP (Crl.) No.11234/2025, titled 'Gursewak Singh vs. State of Punjab', decided on 03.09.

2025, Hon'ble the Supreme Court in a case where the petitioner was being sought to be arrested after a period of 4 years, observed that it was a tenable basis for the Court to have exercised its discretion and granted anticipatory bail. He is not involved in any other case. He is ready and willing to join the investigation as and when required by the investigating agency and will cooperate. MOHIT 2025.12.

At the asking of the Court, Ms. Gagandeep Kaur, DAG, Punjab, accepts notice on behalf of respondent-State. Meanwhile, the petitioner is directed to join the investigation on or before 27.10.2025. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) of BNSS, 2023. However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated.
