The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking directions to de-freeze his Bank Account No.44157808841 maintained with respondent-State Bank of India. 2.

Learned counsel for the petitioner submits that petitioner has joined investigation conducted by police authorities at SAS Nagar. He is not named in the FIR. The amount withheld by respondents is his legitimate money. He may be granted liberty to avail remedies with respect to withholding of money.

Learned counsel for respondent-State Bank of India submits that as on date bank account of the petitioner is operational and there is lien over a sum of Rs. 2,45,139/-. The petitioner may avail remedies as permissible by law with respect to withheld amount. 5.

Heard the arguments and perused the record.

From the perusal of record and arguments of both sides, it is evident that no FIR has been registered against the petitioner. No order of attachment under Section 107 of BNSS has been passed by the Magistrate. In the petitioner's account a sum of Rs.2,45,139/- has been marked suspicious. Bank account of the petitioner is operational. 7.

In the backdrop, the petition stands dispose of with liberty to petitioner to avail remedies as permissible by law with respect to withheld amount. It is made clear that this order shall not legalize any act or omission of the petitioner, if at any stage, he is found involved in the commission of any offence or violation of provision of any law in force. 8.
