(ORAL) By way of present petition filed under Section 482 CrPC, prayer has been made for issuance of directions to the Investigating Agency to present final report before the Illaqa Magistrate relating to FIR No.56 dated 15.03.2019 registered at P.S. City Rajpura, District Patiala under Sections 420, 465, 467, 468, 471 and 120-B IPC. 2.

On 16.01.2024, this Court passed the following order:- "By way of present petition filed under Section 482 CrPC, prayer has been made for issuance of directions to respondents to submit final report before the Illaqa Magistrate in pursuance to FIR No.0056 dated 15.03.2019 registered under Sections 420, 465, 467, 468, 471 and 120-B IPC. A prima facie perusal of the contents of the petition show that the investigation is pending for the past more than 4 years and 10 months and the final report has not been presented so far. It appears that the Investigating Agency has become totally insensitive towards the cause of the petitioner thereby compelling him to approach this Court seeking enforcement of the statutory mandate conferred under the Criminal Procedure Code.

In the meanwhile, the Investigating Agency/Officers responsible for delay in investigation shall deposit a cost of Rs.50,000/- within a period of one week from today which shall be disbursed in favour of the petitioner on account of harassment being faced by him besides, the expenditure incurred upon the filing of the present petition."

In view thereof, learned State counsel has filed a short reply by way of an affidavit of Bikramjit Singh Brar, PPS, Deputy Superintendent of Police, Sub-Division Circle Rajpura, District Patiala dated 31.01.2024 wherein, it has been pointed out that cost of Rs.50,000/- already stands released in favour of the petitioner on 22.01.2024 besides, filing of final report before the Illaqa Magistrate on 20.01.2024 thereby, rendering the present petition as infructuous. 4.

In view thereof, no further cause survives in favour of petitioner.
