The petitioner, who claims to be husband of the detenue Avnit Kaur in the capacity of solemnizing marriage with her on 31.3.2024, had come up before this Court on the grounds that after the marriage, his wife Sapna has been detained by respondent no.4.

The alleged detenue, who is above 19 years of age as well as respondent no.4 are present in Court.

To ensure that the alleged detenue has joined the company of respondent No.4 of her own or under any pressure or duress, this Court has appointed a female advocate namely Ms. Ruby Kaur (P/1712/13) as Amicus Curiae in this case and asked her to interact with the alleged detenue and apprise her willingness to the Court. 4.

Upon her interaction with the alleged detenue, learned Amicus Curiae has submitted the detenue namely Avnit Kaur has left her home of her own without any pressure or duress and there was no danger to her life and liberty at hands of respondent no.4 Dharampreet nor there is any restraint. Rather, she wants to live with him who is also present in Court. The detenue as well as respondent no.4 have submitted copies of their aadhar cards and matriculation certificates in support of their having been of marriageable age, which are taken on record. 5.

In the facts and circumstances of the present case, this Court is of the opinion ASHWANI KUMAR 2024.11.30 15:23 I attest to the accuracy and integrity of this order/judgment Punjab & Haryana High Court, Chandigarh

CRWP-11428-2024   that the alleged detenue is an adult and she is at liberty to live the way she wants or go wherever she wants and no interference of this Court is required at all. 5.

Since the alleged detenue has been brought to the Court by the police officials, they shall ensure that she goes to the place where she wants and the expenses, if any, incurred by them shall be borne by the State.
