*** DEEPAK GUPTA, J. (ORAL) [1] On 11.01.2024, the following order was passed by this Court:- " Present:

Mr. Raman Chawla, Advocate for the petitioner. Mr. Parveen Kumar Aggarwal, DAG, Haryana.

**** CRM-595-2024 This is an application moved by the petitioner to place on record agreement to sell dated 05.09.2023, in order to justify the receipt of ₹ 2,72,000/- from co-accused. Advance copy already supplied to learned State counsel.

Learned State counsel, on instructions from ASI Inder Singh submits that the agreement to sell dated 05.09.2023 (Annexure P-3) has already been verified and found to be genuine and it has been found that petitioner had sold the plot to co-accused Sandeep Singh and in lieu thereof had received ₹ 2,72,000/-vide Annexure P-3. As such, Annexure P-3 is taken on record.

Application is allowed.

Main Case Additional affidavit of Shri Rajesh Kumar Mohan, IPS, Assistant Superintendent of Police, Hisar on behalf of respondent-State along with Annexures R-1 to R-2 (colly) has been filed. Learned State counsel submits that apart from ₹ 2,72,000/-, petitioner had also received an amount of ₹ 1,71,500/- on 15.09.2023 from co-accused Dinesh as is evident from the statement of account. 2024:PHHC:024816 CRM-M-64356-2023 -2Learned counsel for the petitioner has drawn attention towards agreement to sell (Annexure P-3) that total sale consideration of the plot in question was of ₹ 4,72,000/-.

Having regard to the orders earlier passed by this Court on 21.1.2023 and in the light of facts, which have been observed above, let petitioner join the investigation and co-operate in the same. He will not leave the country without prior permission of the Court nor shall make any attempt to contact the complainant of the case or any witness associated with the case. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 438(2) Cr.P.C. Adjourned to 22.02.2024. "

[2] Today, learned State Counsel, on instructions from SI Inder Singh, has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 11.01.2024 and is no longer required for further investigation.

[3] In view of the aforesaid, the order dated 11.01.2024, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.

[4] Disposed of.
