The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of order dated 15.05.2020 (Annexure P-3) whereby he was dismissed from service. 2.

An FIR No.0099/2020, under Section 33A/58 of Delhi Excise Act, 2009 at Police Station Paharganh, New Delhi was registered against the petitioner. On account of registration of FIR, the petitioner was dismissed from service. The petitioner has been acquitted vide judgment dated 09.12.2023 passed by Additional Chief Metropolitan Magistrate, New Delhi. The petitioner after acquittal in the criminal trial has preferred an appeal assailing order of dismissal before Appellate Authority and the said appeal is stated to be pending.

Learned counsel for the petitioner submits that, at this stage, grievance of the petitioner would be redressed if Appellate Authority is directed to decide his appeal in a time bound manner. 4.

Learned counsel for the respondents asserts that the Appellate Authority would decide appeal of the petitioner within two months from today.

In the wake of statement of learned counsel for the parties, the present petition stands disposed of.
