The present contempt petition has been filed for deliberate and intentional disobedience of order dated 11.07.2024 passed by the Co-ordinate Bench of this Court in CWP-6409-2021. 2.

Vide order dated 11.07.2024, the following direction was issued by the Co-ordinate Bench of this Court:- "In view of the above, the present writ petition is disposed of with a direction to the respondents to consider the petitioner for promotion and in case, found eligible and suitable, as also there being no other impediment, promote him as such from the date that of his junior, with consequential benefits in accordance with law. Needful be done within a period of two months, from

-2the date when a certified copy of this judgment is received by the respondents."

Compliance report by way of affidavit of Pradeep Dahiya, IAS, Deputy Commissioner-cum-Collector, District Jhajjar, has been filed on behalf of the respondent. The same is taken on record. The relevant portion of the said compliance report is reproduced as under:- "4.

That in pursuance to comply with the Hon'ble High Court order dated 11.07.2024, the office of deponent considered the case of the petitioner Sanjay Kumar Patwari for promotion for the post of Field Kanungo and in this continuation, he has been promoted to the post of Field Kanungo in the pay scale of Rs.9300-34800+4200 GP from the date of his junior's promotion of Sh. Krishan Chander i.e. from dated 26.10.2020 in accordance with service rules vide Order Endst. No.2354/SK dated 10.12.2024 in letter and spirit of the order dated 11.07.2024 (enclosed as Annexure R-1).

That it is further submitted that it is an article of faith for the deponent that the dignity of all Hon'ble Courts of law must be maintained. The deponent cannot disobey the directions passed by this Hon'ble Court. However, if still this Hon'ble Court comes to the conclusion that any act on the part of the deponent amounts to contempt of court, the deponent tenders an unconditional apology before this Hon'ble Court."

Learned State counsel contends that in compliance of order dated 11.07.2024 passed by learned Single Bench, order dated 10.12.2024 has been passed by the Collector, Jhajjar, whereby petitioner-Sanjay Kumar has been promoted as Field Kanungo. Learned counsel for the petitioner does not dispute the same.

In view of the above, the present contempt is purged and rule is discharged.
