Tribhuvan Dahiya, J (Oral) The petition has been filed, inter alia, seeking a writ of certiorari quashing the order dated 15.03.2013, Annexure P-2, whereby the petitioner's husband was regularised in service as Sweeper-cumChowkidar with effect from 01.04.2011. 2.

It is claimed that the petitioner's husband was entitled to be regularised in service on completion of ten years as part-time Sweepercum-Chowkidar with effect from 01.01.1999 in terms of Government Policy/ Instructions dated 30.12.1998/25.02.1999. 3.

As per facts apparent on record, after regularisation of service of the petitioner's husband, as aforementioned, he unfortunately died on 29.12.2014. Ever since his wife/petitioner herein is getting family pension. At this stage, the claim for ante-dated regularisation on behalf of her late husband cannot be entertained, especially when he stood regularised while in service vide order dated 15.03.2013, which was never challenged by him.
