Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to promote the petitioner as Superintending Engineer w.e.f. 03.02.2021, along with all consequential benefits being a physically handicapped employee in view of the instructions dated 11.07.2023 (Annexure P-2) issued by the Chief Secretary to Government of Haryana with regard to grant of reservation in promotion to the persons with disabilities under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.

Learned counsel for the petitioner submits that for claiming the aforesaid relief, the petitioner has submitted a legal notice dated 12.11.2024 (Annexure P-10) and at this stage, the petitioner would be MOHD YAKUB 2024.11.28 18:46 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CWP No.32095 of 2024 satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

Mr. Saurabh Mohunta, DAG, Haryana, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to consider and decide the legal notice dated 12.11.2024 (Annexure P-10), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of three months from the date of receipt of certified copy of this order.
