( 4 Present writ petition has been filed for quashing the letter/order dated 06.12.2023 (Annexure P-4) passed by respondent No.8/Block development and Panchayat Officer, Gandiwind vide which a rowing and fishing enquiry has wrongly and illegally been ordered to be conducted against the petitioner/Sarpanch with regard to the grants given by the Government at various points of time during this tenure from January, 2019 till date, without involving the Panchayat Secretaries, Junior Engineers and Block Development and Panchayat Officers concerned, under whose supervision and permission, the said grants given by the Government for various development works of the Gram Panchayat were spent.
Learned counsel for the petitioner has submitted that the petitioner is the elected Sarpanch of the village and he has been RITTU 2023.12.22 16:36 I attest to the accuracy and integrity of this document

He submits that in pursuance to the notice issued, the petitioner though had earlier appeared before the respondents authorities with the record which was available with him. However, the same was not accepted and the petitioner is being compelled to produce the record lying with the J.E. He submits that the relevant record should be produced by the Technical Authorities. On asking of the Court,
After hearing learned counsel for the parties, the present petition is disposed of with liberty to the petitioner to appear before respondent No.8 in pursuance to the notice issued. However, respondent No.8 is directed that after hearing the petitioner, direct the Technical Authorities to produce the record, if the assertion of the petitioner that the record is not available with him, is found to be correct. 8 ( 9 !" #"
