The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue him passport.

The petitioner applied for passport on 7.08.2023. An FIR No.59 date 28.04.2014, under Sections 307, 326, 325, 324, 323, 341, 506 of IPC was registered against the petitioner at Police Station, Kamboj, District Amritsar. The petitioner was convicted vide judgment dated 14.03.2018. The petitioner filed CRA-S-159-SB of 2018 before this Court. Sentence of the petitioner stands suspended vide order dated 15.11.2018 passed by this Court.

Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.
Counsel for Union of India, who on advance notice is present in Court, submits that petitioner has been issued notice and he may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within six weeks. 5.
Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 11.01.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order, in accordance with law, within six weeks from 11.01.2024.
