Instant Habeas Corpus petition has been filed by the petitioner - Deepak, aged about 25 years, for releasing of detenue, namely, Sapna (aged about 20 years), who is legally wedded wife of the petitoiner, from the illegal custody of respondents No.4 to 6.

On 13.10.2025, after hearing learned counsel for the petitioner, following order was recorded:- "2.

Counsel for the petitioner contends that petitioner and 'Sapna' daughter of respondent No.4, knew each other since long and accordingly, they solemnized marriage with each other on 25.11.2024, as per Hindu rites and rituals at Sarv Dharam Vivah Mandal Trust, Vijay Nagar, Rohtak and thereafter started living together as husband and wife. In support of his contention, counsel refers to the marriage certificate which is annexed along with the present petition as Annexure P.1. further submits that on 20.03.2025, Nos.4 to 6 along with other friends and relatives took away detenue 'Sapna' and detained her at some unknown place. Despite petitioner's repeated requests, respondent Nos.4 to 6 are not disclosing the whereabouts of his wife i.e. detenue 'Sapna'. Thus, he approached this Court by way of present Habeas Corpus petition. 3.

Notice of motion.

On asking of the Court, Mr. Kanwar Sanjiv Kumar, AAG, Haryana, who is present in the Court, accepts notice for respondents No.1 to 3 (State) and seeks time to get instructions and to file status report, if any.

Let requisite copies of the complete paper book be handed over to the learned State counsel, during the course of the day. 5.

Meanwhile, respondent No.2- The Superintendernt of Police, Rohtak is directed to immediately depute some responsible police officer(s)/official(s), not below the rank of Sub-Inspector, to visit the house(s) of respondent Nos.4 to 6 or any other place of detention, where the any alleged detenue 'Sapna' is illegally detained. The concerned police officer(s)/official(s) would record the statement of the alleged detenue 'Sapna'. Such officer would ensure that the statement of the alleged detenue 'Sapna' is free from kind of influence, fear or pressure, and thereafter, report prepared by him/her be produced before this Court on or before the hearing fixed before this Court.

After recording the statement, if such officer(s)/official(s) realises that detenue is major and has been illegally detained, he/she would get her released immediately.

On the previous date of hearing, i.e., 30.03.2026, the detenue 'Sapna' was directed to appear before this Court so as to ascertain her independent statement/view as to whether she is residing happily with her parents or not.

In compliance thereof, today, detenue 'Sapna' is present in Court along with her father (respondent No.4 herein). Inside the Chamber, certain deliberations were held with her in the presence of two Law Researchers of this Court, namely Ms. Medha Sharma and Ms. Anmol Sharma.

During the course of such interaction, detenue 'Sapna' clearly stated that the petitioner - Deepak is her Bua's son, and earlier both of them

- 3 - were residing together as a married couple.

She further stated, without any influence, pressure or fear, that she is presently residing happily with her parents, i.e., respondents No.4 & 5 herein, and is not desirous of going along with the petitioner - Deepak. 6.

In view of the stand taken and the statement made by the detenue 'Sapna', this Court does not find any substance in the present petition. Accordingly, same is found to be devoid of merit and stands dismissed.
