CRM-M-60415-2024
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-60415-2024 Date of Order: 04.12.2024 Raj Kaur ... Petitioner(s)
Versus
State of Punjab & others
...Respondent (s)
CORAM:
HON'BLE MR. JUSTICE ANOOP CHITKARA Present:- Mr. Vikram Jeet Singh, Advocate for the petitioner(s). Ms. Swati Batra, DAG, Punjab.
*** ANOOP CHITKARA, J.
1.
The petitioner has filed the present petition under Section 528 BNSS for issuance of direction to respondent no.2-SSP, Jalandhar to transfer the inquiry which is pending with respondent no.3-SHO, as they have been harassed by respondent no.3 under the garb of inquiry.
2.
Counsel for the petitioner submits that in case the petitioner is required by the investigator, she would voluntarily join such inquiry/investigation. He further submits that the moment the petitioner is called from Sangrur to Jalandhar, she not only feels uncomfortable but it is expensive as well.
3.
State's counsel submits that the petitioner was never troubled and in fact, the inquiry was made because certain calls were made from the mobile phone of the petitioner's son to the daughter of the complainant on her mobile phone and there is no reason for the police to make inquiry.
4.
Given above, the present petition is disposed of with a direction that in case the petitioner's presence is required in the inquiry, such approval for summoning the petitioner be taken from concerned DySP/SSP, Jalandhar. All pending applications, if any, stand disposed.
