Mr. H.S. Deol, Senior Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.273 dated 20.12.2017 under Sections 420, 465, 468, 471, 120-B of the IPC registered at Police Station Zira, District Ferozepur.

Vide order dated 09.01.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "On being put to notice, learned State counsel, on instructions, has not disputed that the following submissions made by the learned counsel for the petitioner on the last date of hearing:

"Learned counsel for the petitioner inter alia contends that the petitioner although named as an accused in the FIR in question was never challaned and sent to face trial in the FIR in question; meanwhile the trial proceeded qua the co-accused, who stands acquitted by the learned Trial Court vide order dated 21.11.2023. It has also been submitted by the PUNEET SACHDEVA 2025.04.03 14:21 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-60241-2024 -2learned counsel that after the registration of the FIR in question and during pendency of the trial qua the co-accused, no proceedings under Section 82 of the Cr.P.C. were initiated against him."

Learned State counsel, on instructions, submits that the petitioner has joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 09.01.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
