RA-CW-437-2023 The applicant-respondent is seeking review/recalling of order dated 21.11.2023 on the ground that petition has been disposed of in the light of judgment of Supreme Court in 'State of Himachal Pradesh Vs. Sheela Devi' 2023 Livelaw (SC) 662 whereas said judgment is not applicable to the present case.

Mr. Sandeep S. Majithia, Advocate and Mr. Arun Gosain, Senior Panel Counsel submit that at the time of disposal of main petition they could not apprise the Court in true prospective which resulted into disposal of main petition in the light of judgment of Supreme Court in Sheela Devi (supra).

It is relevant to notice that respondents herein are Union of India and NIPER. As Mr. Arun Gosain, Senior Panel Counsel is present alongwith Mr. Sandeep S. Majithia, Advocate the objection of learned counsel for the petitioner is not sustainable and this Court finds that matter needs to be examined. Accordingly, application is allowed and petition is restored to its original number.
