(Oral) This petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to grant benefit of step-up of pay to petitioners no.1 to 8 & 17 with effect from 27.11.2019 and petitioners no.9 to 16 with effect from 01.11.2019 at par with their junior counter part, along with all consequential benefits and interest at the rate of 12 per cent per annum with effect from the due date till the date of actual payment. 2.

Learned counsel for the petitioners submits that grievance raised herein is pending for appropriate decision before the respondents. At this stage, the petitioners will be satisfied in case respondent No.2 is directed to decide the pending legal notice, dated 25.09.2023, Annexure P-6, in a specified period.

Notice of motion.

Mr. Sanjeev Kaushik, Addl. AG, Haryana, appearing on advance notice, submits that the pending legal notice shall be decided by respondent No.2 expeditiously.

In view thereof, without going into merits of the case, the petition is disposed of with a direction to respondent No.2/Director General, Department of Secondary Education, to consider and decide the pending legal notice dated 25.09.2023, by passing a speaking order in accordance with law, within a period of three months from the date of receiving a certified copy of this order. In case the petitioners are found entitled the benefits claimed, the same shall be released to them within a period of six weeks therefrom. 6.

In case the order is not passed within the stipulated period, the officer concerned shall pay costs of ₹25,000 to the petitioners.
