The present revision petition has been filed under Article 227 of the Constitution of India challenging the order dated 29.07.2024 (Annexure P-30) whereby the application filed by respondent No.1 under Section 10 of the Code of Civil Procedure, 1908 (CPC) for staying the proceedings in the counter-claim was allowed.

Learned counsel for the respondent No.1, on instructions, would contend that he would have no objection if the order dated 29.07.2024 staying the proceedings in the counter-claim is set aside. He, however, prays that the matter be decided in a time-bound manner.

In view of the statement made by the learned counsel for the respondent No.1, the order dated 29.07.2024 (Annexure P-30) is set aside. The Trial Court shall frame the issues in the counter-claim and shall make an endeavour to decide the matter in accordance with law preferably within a YOGESH SHARMA 2026.01.28 10:48 I attest to the accuracy and authenticity of this order/judgment.

CR-6970-2024 (O&M) period of six months from today. Both the parties would be given four effective opportunities each to lead their evidence and the Trial Court is requested not to grant any unnecessary adjournments to either of the parties. 4.
