In the present petition, the challenge is to the impugned order dated 29.01.2019 (Annexure P-1) passed by respondent No. 1-Armed Forces Tribunal, Regional Bench, Chandigarh by which, the benefit of service element alongwith disability element of disability pension has been granted to respondent No. 2.

Learned counsel for the parties concedes that the issue raised in the present petition is covered by the judgment passed by this Court while passing the order in CWP-31046-2024- 'Union of India and others versus No. 9513143P Ex. Hav (AEC) Kapil Dev and another, decided on 12.08.2025'

, wherein the petition filed by the Union of India was dismissed. 3.
