The present petition has been filed under Section 482 of BNSS, 2023 for grant of pre-arrest bail to the petitioner in Rapat No.26 dated 04.08.2024 registered under Sections 115(2), 117(2), 3(5) of BNS, 2023 (Section 109 and 238 of BNS, 2023 added lateron) at Police Station Talwandi Bhai in cross case FIR No.43 dated 01.08.2024 under Sections 303(2), 126(2), 115(2), 3(5) of BNS, 2023 registered at Police Station Talwandi Bhai, District Ferozepur.

Learned counsel submits that the petitioner and the complainant are real brothers and the incident had taken place in the fields with regard to which a civil suit filed by their

-2father had been decreed in his favour vide Annexure P-14. FIR came to be lodged by the petitioner against the complainant of the DDR with regard to the injuries caused to him with a dang for which there is an MLR referred to as Annexure P-2 wherein he is on bail. In the said scuffle, the complainant in the present DDR is stated to have received certain injuries being falling on the cultivator of the tractor as explained in the FIR. The medical board had shown the injuries received to be grievous, however, after one year without the previous record being available, it was opined that the same, if not treated, would have been dangerous to life. The petitioner is ready and willing to join the investigation as and when required by the investigating agency and will cooperate.

Notice of motion.

At the asking of the Court, Ms. Gagandeep Kaur, DAG, Punjab, accepts notice on behalf of respondent-State. At this stage, Mr. Piyush Sharma, Advocate has entered appearance and filed his vakalatnama on behalf of the complainant which is taken on record.

Meanwhile, the petitioner is directed to join the investigation on or before 28.10.2025. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) of BNS, 2023. However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated.
