The petitioner, who claims to be father of the alleged detenue namely Kalsuman, had come up before this Court under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of habeas corpus, directing respondents no.1 to 3 to produce the alleged detenue before the Court. 2.

State's counsel, on instructions, submits that the alleged detenue has been traced out and her statement has been recorded, in which she has stated that she is above 18 years of age and is in safe house where she is presently living and rather, she apprehends threat at the hands of her father i.e. the petitioner. 3.

Admittedly, the alleged detenue is above 18 years of age and thus, she has every right to live the way she wants or move wherever she likes. Neither this Court nor the State can interfere with her liberty at all.

Upon this, counsel for the petitioner submits that the petitioner be permitted to meet her.

CRWP-11523-2024 father, the Incharge of the safe house shall arrange a short meeting of an hour with him. However, before the meeting, the petitioner shall be thoroughly frisked by the police officials. It is clarified that this order shall remain in force for one week from today and thereafter, the same shall eclipse. Petition is disposed of. All pending applications, if any, stand disposed.
