Through the instant criminal writ petition, the petitioner craves for issuance of a mandamus upon the respondent No.2 to ensure protection of life and liberty of the petitioner and his family members, at the hands of respondent No.3, who has been harassing them, by not permitting them to enter their own house.

On the last date of hearing, i.e. 08.01.2024, this Court had directed the S.H.O. concerned to record his personal appearance before this Court and accordingly, the S.H.O. concerned has complied with the said directions through causing his personal appearance today before this Court.

The S.H.O. concerned has informed this Court that since the son of the petitioner is involved in a criminal case, therefore, the investigating officer of the said case, purely in order to trace the DEVINDER YADAV 2024.01.10 09:59 I attest to the accuracy and authenticity of this order/judgment

CRWP-12512-2023 2024:PHHC:001636 whereabouts of the son of the petitioner, had conducted raid in the house of the petitioner, that too in accordance with law and as such, no harassment was caused to the petitioner. He submits that neither does he has any role whatsoever in the harassment, as alleged by the petitioner, nor he ever restrained the petitioner and his family member to live in their own house.

In view of the submission made hereinabove by the S.H.O. concerned, no further interference of this Court is required, as the S.H.O. concerned has assured this Court that there is no impediment for the petitioner and his family members to live in their own house. 5.

Consequently, the instant petition is dismissed, as having been rendered infructuous.
