The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 02.07.2024 (Annexure P-21) whereby respondent-Commandant, First Commando Battalion, Bahadurgarh has imposed punishment of forfeiture of 05 annual increments. In the order itself, it is specifically mentioned that this order is appealable and appeal lies before Deputy Inspector General of Police, Commando, Punjab, Bahadurgarh. He is further seeking setting aside of order dated 24.09.2024 (Annexure P-29) whereby he has been placed under suspension. The respondent has initiated departmental enquiry.

Concededly, the impugned order of punishment is an appealable order. It is not only appealable, the petitioner has remedy to file revision against the order passed by the appellate authority. With respect to order whereby he has been placed under suspension, it is apt to notice that he has been granted subsistence allowance and he has remedy to join departmental proceedings and put forth his stand. If any adverse order is passed against him, he would be free to challenge before the authorities.

It is hereby clarified that if petitioner files appeals within two months from today, the appellate authority would decide his appeal on merits and without adverting to question of limitation.
