AARADHNA SAWHNEY , J (ORAL) By means of instant petition filed under Article 226 of the Constitution, petitioner seeks a writ in the nature of Habeas Corpus for appointment of a Warrant Officer to search for the detenue namely 'Simpy Kumari' daughter of Balwinder Yadav at the premises of respondent No.5 or any other place to be pointed out by the petitioner and get her released from the illegal custody of respondent No.5.
Detenue-Simpi Kumari is present in Court today along with respondent No.5-Akshay son of Hari Ram. She (detenue) has stated that her date of birth is 21.06.2006 and that she has performed marriage with respondent No.5Akshay on 07.10.2025 out of her free will and volition without any fear, threat or coercion. She has further stated that she is living happily with her husband and would like to reside with him.
A copy of order dated 08.10.2025 passed by learned Sessions Judge, Ludhiana, directing police officials to ensure protection to the life and liberty of detenue and her husband qua threat perception, in accordance with law has also been placed on record.
