The present petition has been filed under Section 482 of the Code of Criminal Procedure for quashing the impugned order dated 01.02.2023 (Annexure P-2) passed by Sub Divisional Judicial Magistrate, Batala, District Gurdaspur whereby the petitioner has been declared as a proclaimed offender in case FIR No.172 dated 12.11.2020 (Annexure P-1) under Sections 420 and 506 of IPC, registered at Police Station Rangar Nangal, Police District Batala, District Gurdaspur. 2.

Vide order dated 22.12.2023, the impugned order dated 01.02.2023 had been stayed.

Learned State counsel submits that the petitioner did not join the proceedings, however, could not deny the fact that the operation of the impugned order had been stated by this Court. Manju 2024.04.29 10:15 I attest to the accuracy and integrity of this document

It is also submitted by the counsel for the petitioner that subsequent thereto, the parties have compromised the matter after getting their statements recorded to the said effect and the FIR also stands quashed by this order in CRM-M-64815-2023.

In light of the above, the purpose of declaring the petitioner proclaimed person in an FIR which itself has been quashed by this Court, no useful purpose would be served, therefore, the present petition is allowed and order dated 01.02.2023 (Annexure P-2) is set aside without prejudice to the rights of the complainant.
