Both the instant petitions have been filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail to the petitioners in case FIR No.96 dated 02.10.2023, under Sections 406, 498-A IPC, 1860, registered at Police Station Women, District Police Commissionerate, Jalandhar.

Learned counsel for the petitioners submits that the petitioners are ready to amicably settle the matter and they are even ready to deposit a sum of Rs.24,00,000/- by way of an FDR in favour of the complainant. It is

 further submitted that compromise talks are going on inter se the parties. However, the compromise is yet to be finalized. 3.

On the other hand, learned counsel for the complainant submits that the compromise could not be finalized.

Learned State counsel, on instructions from ASI Sukhdev Singh, submits that petitioners-Pardeep Jot Singh Gill and Gurmail Singh Gill have joined investigation in compliance of the order dated 31.01.2024, passed in CRM-M-64922-2023 and order dated 04.12.2023, passed in CRM-M-60956-2023 respectively.

It is a matrimonial dispute inter se the parties. Peitioner-Pardeep Jot Singh Gill is the husband and petitioner-Gurmail Singh Gill is the father-in-law of the complainant. The allegations and counter-allegations inter se the parties are a matter of trial. The petitioners have joined the investigation in compliance of the order of this Court. 6.

Keeping in view the above facts and circumstances and in view of the reasons recorded in the aforesaid orders dated 31.01.2024 and 04.12.2023, both the present petitions are allowed. Interim order dated 31.01.2024, passed in CRM-M-64922-2023 and interim order dated 04.12.2023, passed in CRM-M-60956-2023, are made absolute, subject to the conditions laid down in Section 438(2) Cr.P.C. and also subject to the condition that the petitioners-Pardeep Jot Singh Gill and Gurmail Singh Gill would jointly deposit a sum of ₹24,00,000/- in the shape of an FDR in favour of the complainant within a period of 15 days from today. The said FDR would be submitted before the Chief Judicial Magistrate, Jalandhar, which shall be handed over to the complainant/first informant in the FIR, upon proper receipt and identification.

However, it is made clear that nothing expressed hereinabove would be construed to be an expression of opinion on merits of the case. 8.

In case the petitioners violate any of the above conditions or the conditions stipulated under Section 438(2) Cr.P.C., the present order shall stand vacated without any further reference to this Court. 9.

Pending miscellaneous applications, if any, shall stand disposed of.
