***** ARCHANA PURI, J. (Oral) Vide this order, I shall dispose of two applications, filed by Shivika Dogra-applicant/wife, for seeking transfer of the litigation, pending between the parties to the lis.

TA-1531-2024 has been filed by the applicant for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/543/2024, titled 'Col. Ajay Dogra Vs. Shivika Dogra'. TA-78-2025 has been filed by the applicant for seeking transfer of the civil suit i.e. CS/848/2024, titled 'Col. Ajay Dogra Vs. Shivika Dogra'.

Both the aforesaid cases are pending in the Courts at Panchkula and the applicant is seeking transfer of the same to the Court of competent jurisdiction at Ludhiana.

In pursuance of the notice issued in both the applications, respondent made appearance through counsel. However, the counsel submits that the respondent has no objection, if the transfer applications are accepted and the litigation pending at Panchkula, is tranferred to the Courts at Ludhiana.

From the contents of both the applications, it is evident that there are two children born from the wedlock of the parties and both of them are in the care and custody of the applicant. Elder son, namely, Parth Dogra, is suffering from 'Autism'. Also, the petition under Section 125 Cr.P.C. i.e. MNT-125/8/2024, arising from this matrimonial dispute, is already pending in the Courts at Ludhiana.

In view of the aforesaid fact situation, more particularly, considering the statement made by the counsel for the respondent, both the transfer applications i.e. TA-1531-2024 and TA-78-2025 are hereby allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/543/2024, titled 'Col. Ajay Dogra Vs. Shivika Dogra' and the civil suit i.e. CS/848/2024, titled 'Col. Ajay Dogra Vs. Shivika Dogra', stand

transferred from the Courts at Panchkula, to the Court of competent jurisdiction at Ludhiana. The requisite record of the aforesaid cases be sent by the Courts concerned, to the District and Sessions Judge, Ludhiana. Learned District and Sessions Judge, Ludhiana, shall assign the said cases to the Court of competent jurisdiction at Ludhiana. Even, the parties are directed to appear before the concerned Court(s), within a period of one month from today onwards.
