The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondent No. 2 to issue him passport.

An FIR No. 0011 dated 17.01.2018, under Sections 498-A and 406 of IPC came to be registered against the petitioners at Police Station Model Town, Hoshiarpur. The police conducted investigation and found both the petitioners innocent. The report prepared by investigating officer has been accepted by Senior Superintendent of Police, Hoshiarpur. The petitioners besides said fact had filed CRM-M- 29911 of 2018 titled as "Bikramjit Singh and others vs. State of Punjab and another" before this Court seeking quashing of aforesaid FIR. The petitioners applied for PARAMJIT KAUR SAINI 2024.01.05 15:38 I attest to the accuracy and authenticity of this order/judgment

CWP No.29475 of 2023 -2- 2024:PHHC:000412 passport on 18.07.2023. Their applications are pending on account of aforesaid FIR.

Counsel for the petitioners submits that case of the petitioners is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.

State counsel does not dispute the factual position with respect to the aforesaid FIR 5.

Counsel for Union of India submits that applications of the petitioners have already been closed and if petitioners file fresh applications, it would be considered and disposed of, in accordance with law. 6.

Faced with this, counsel for the petitioners seeks permission to withdraw the instant petition with liberty to file fresh applications before the passport authority.
