The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No. 138 dated 23.10.2023 registered under Sections 307, 506, 148, 149 and 120-B of the Indian Penal Code, and Sections 25(6), 25(7) and 25(8) of the Arms Act, 1959 registered at Police Station Nihal Singh Wala, District Moga. 2.

Mr. Jatin Bansal Kotashamir, Advocate has put in appearance and files his fresh Power of Attorney on behalf of the petitioner as the earlier counsel has joined the Office of Advocate General, Punjab. The same taken on record.

Custody certificate as well as status report by way of an affidavit of Mr. Paramjit Singh, PPS, Deputy Superintendent of Police, Sub-Division Nihal Singh Wala, District Moga, have been filed by the learned State counsel in Court today, which are taken on record. Copies PARUL 2024.04.02 13:15 I attest to the accuracy and authenticity of this document thereof have been supplied to the learned counsel for the petitioner.

Learned counsel for the petitioner prays for withdrawal of the present petition with liberty to file afresh with better particulars as petitioner does not wish to pursue the present petition at this stage. 5.

In light of the above, the present petition stands dismissed as withdrawn with the aforesaid liberty.

It is made clear that this Court has not expressed any opinion on the merits of the case and the liberty granted if any is only on the request of the counsel for the petitioner and is not a direction. 7.

Pending miscellaneous application if any also stands disposed of.
