  The petitioner has filed this petition under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of sole arbitrator to adjudicate upon the disputes and differences due to the failure of the respondents to make lawful payments under the work order No. 04/CHP/RGTPP/2017B18 dated 06.10.2017 for annual running contract of operation and maintenance of automated coal handling plant at Khedar, Hisar. 2.

Vide order dated 10.05.2024 passed by this Court, Justice Girish Agnihotri, a former Judge of this Court, was proposed to be appointed as Arbitrator to adjudicate upon the disputes between the parties. Necessary declaration sought under Section 12(5) of the Act of 1996 has been received from the proposed arbitrator.

In view of the above, the petition stands disposed of. The order dated 10.05.2024 passed by this Court is made absolute. The learned Arbitrator shall proceed with the matter in accordance with law. The objections are left open to be decided by the Arbitrator.
