Through the instant petition filed under Section 438 Cr.P.C., prayer is made for grant of anticipatory bail to the petitioner in case FIR No.48, dated 07.09.2023, under Sections 379-B, 341 and 34 of IPC, registered at Police Station Mattewal, District Amritsar. 2.

The prosecution case as curled out from the FIR reads as under:- "Statement of Nishandeep Singh son of Swaran Singh Resident of Kokri Kalan Police Station Ajitwal District Moga, Aged about 24 years Mobile:- 6280993724 stated that I am a resident of the said address and I am Swatantra Micro Fin Pvt. Ltd. as a Field Officer in Company Batala. Every month I collect the installment of the loan from the village and deposit it in the Batala office. Today it will be around 05:00 in the evening that I on my motorcycle number PB-03AR-6392 CT-100 company Bajaj and I was having the installment of rs.1,00,000 in a bag and was going from village Bagga to Batala. When I reached a little ahead of Langarhal Baga from village Bagga, one motorcycle Splendar came from the front and 2 young men were riding on it.

Whose faces were covered but I can recognize them. The motorcycle driver had a veil tied on his head and they stopped my motorcycle by putting his motorcycle in front of my motorcycle and the young man sitting behind him started hitting me with baseball and they took the bag in which 1 lakh rupees and my mobile phone company VIVO and the phone SAMSUNG given by the company were also taken away.

Tahali sahib Police Station Mattewal Dated 07/09/2023 Action Police: Today ASI including ASI Tejpal Singh No: 1688 including ASI Gurmeet Singh No: 1018, CT Germanjit Singh No: 1947, PHG Baljit Singh No: 2795 including personal laptop printer in the private vehicle patrol, there was a government school village Bagga near T point that I have Nishandeep Singh son of Swaran Singh resident of Kokri Kalan police station Ajitwal district Moga along with Krishna Chandra ASTT.

Branch Manager Batala was present and the said Nishandeep Singh recorded his statement before me, which statement was written and read out and explained to him, who accepted his statement as correct and signed his statement in English, which was confirmed by Krishna Chandra ASTT. Branch Manager Batala confirmed. The statement is found to be an offense under 379-B, 341, 34 IPC. Case registered and handed to PHG Gurdayal Singh No: 19869 and sent to police station. By registering the case, the number should be informed about the case, the control room should be notified by Bajria Wireless. special report to be issued in the service of Balatra officer ASI along with fellow employees, including the complainant. Today -village Bagga AT:- 7:45 PM SD/Jatinder Singh AS IC/PP.

Tahli Sahib Police Station Mattewal Dated 07/09/2023 Today Police Station: At this time the said statement in police station, the said case was registered against the said unknown accused and the original written copy of FIR was sent to the ASI through the employee and sent for investigation. By issuing a special report, sent through HC Baljinder Singh 999 is being sent to the service of the District Magistrate Sahib and senior officers. Control room through Bajria wireless notification is being given. Report No. 26 Time 20:45."

Mr. Mohit Chaudhary, AAG, Punjab, accepts notice on behalf of respondent-State, and waives service and opposes the grant of interim bail to the petitioner.

The Court has heard both the counsel for the parties and has gone through the case file.

The record of file reveals that the petitioner is the main accused, who has caused grievous injury on the left elbow/forearm, and multiple injuries on the head and abdomen of the victim while committing the offence of snatching.

The other co-accused of the petitioner, has already been arrested, and qua one of the accused, attribution is of informing about the location of the victim and other was the accused who associated with the present petitioner. Therefore, this Court is not inclined to grant the relief of anticipatory bail to the petitioner, who has caused grievous injuries at the time of snatching.
