The present petition has been filed under Section 528 of BNSS, 2023 for quashing of order dated 16.08.2024 passed by learned Judicial Magistrate Ist Class, Patiala in complaint filed under Section 138 of the Negotiable Instruments Act i.e. COMA No.3642 of 2019, dated 19.10.2019, titled as "Baljit Garg vs Sajjan Singh, etc.", vide which bail order of the petitioner was cancelled and his bail/surety bonds were forfeited to the State and non-bailable warrants have been issued. Further prayer has been made to quash the order dated 12.11.2024, passed by learned Judicial Magistrate Ist Class, Patiala, vide which the petitioner has been declared as proclaimed offender. 2.

On 04.12.2024, the following order was passed by this Court:- "Learned counsel for the petitioner submits that he is being proceeded against a complaint under Section 138 MOHD YAKUB 2025.05.09 10:32 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CRM-M-60818-2024 of the Negotiable Instruments Act, wherein he was not properly served and proceedings under Section 82 Cr.P.C. came to be initiated and have been culminated in a hurried manner.

Learned counsel submits that the petitioner in any case is willing to surrender before the trial Court and to associate with the proceedings of trial and shall also make some efforts to amicably resolve the matter.

Meanwhile, operation of the impugned order be kept in abeyance.

The petitioner is directed to appear before the trial Court within two weeks from today. Upon appearance of the petitioner, he shall be released on interim bail." 3.

Learned State counsel, on instructions from ASI Subhash Chander, submits that the petitioner has complied with the direction issued by this Court and has put in appearance before the learned Judicial Magistrate Ist Class, Patiala, and he has already been released on bail.

In view of the above, no further directions are required to be passed. Accordingly, the present petition is disposed of and the impugned orders dated 16.08.2024 and dated 12.11.2024, passed by learned Judicial Magistrate Ist Class, Patiala, are set-aside.
