The applicant through instant application under Section 11(6) of the Arbitration and Conciliation Act, 1996 (for short "1996 Act") is seeking appointment of an Arbitrator to adjudicate the dispute between the parties. 2.

The applicant entered into contract with respondent-State of Rajasthan. As per contract, the goods had to be delivered at Jaipur. The arbitration agreement provides that venue of Arbitration would be Jaipur. 3.

Mr. Joginder Pal Sharma, Advocate submits that jurisdiction of this Court is invoked because goods were manufactured in the State of Punjab and thereafter despatched to respondent. 4.

The goods may be manufactured within the jurisdiction of Court, however, the delivery was effected beyond the jurisdiction of this Court. The arbitration agreement specifically provides that venue of Arbitration would be Jaipur.
