Through the instant petition, as instituted under Section 482 of the B.N.S.S., 2023, the petitioner seeks the concession of anticipatory bail, in FIR No.234 dated 15.11.2024, under Sections 406, 420 and 506 of the IPC, registered at P.S. Pillukhera, Jind.

The learned counsel for the petitioner submits that, the petitioner did not play any role in committing the present offence, rather his role is confined only to the sphere that, he disclosed the complainant about the person/co-accused who sent him abroad. He further submits that, out of the entire amount, which is alleged to be cheated, the petitioner has only received an amount of ₹ 1,00,000/-.

This Court has considered the submissions made by the learned counsel for the petitioner and also perused the record. 4.
It is not at all disputed by petitioner's counsel that, the petitioner has received some amount from the complainant. Moreover, there DEVINDER YADAV 2024.12.03 16:56 I attest to the accuracy and authenticity of this order/judgment
CRM-M-60312-2024 are specific allegations of inducing the complainant for sending him abroad and this inducement resulted in the complainant becoming cheated for ₹16,50,000/-. Not only the complainant suffered huge monetary loss, but, he was also kept in illegal confinement at Bangkok. 5.
Prima facie, this Court is of the view that, the petitioner along with his co-accused is running a racket of cheating gullible people, who are desirous of going abroad for better life prospects. Therefore, taking into account the gravity of the allegations, this Court is not inclined to grant the extraordinary relief of anticipatory bail to the petitioner. 6.
In summa, the instant petition is dismissed.

However, anything observed hereinabove shall neither be construed to have any bearing on the outcome of the trial, nor the trial Court concerned shall be influenced by any of the observations recorded herein.
