Mr. Subhash Godara, Advocate and Mr. Aman Godara, Advocate, for the complainant. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner has filed this first petition for grant of regular bail in case FIR No. 241 dated 25.07.2024 under Sections 109(1), 351(3) of the Bharatiya Nyaya Sanhita-2023 (Section 238(a) of BNS added later on) registered at Police Station IMT Rohtak.

The petitioner is in custody since 28.07.2024 having been alleged with the offence of attempt to murder arising out of an incident where he assaulted the complainant/victim causing grievous injury of fracture of Fibula. Custody certificate filed by respondent-State of Haryana is taken on record.

It is contended by learned counsel for the petitioner that the said medico-legal report was prepared three days later of registration of FIR.

Looking to the seriousness of the offence, this Court is not inclined to grant bail to the petitioner. Accordingly, the petition for grant of regular bail for the time being is dismissed with liberty to the petitioner to revisit the Court after examination of the injured witness or if the trial is further delayed, whichever is earlier.
