This is the second petition for grant of anticipatory bail, the first one i.e. CRM-M-53596-2024 having been dismissed as withdrawn on 22.11.2024. The order dated 22.11.2024 passed in CRM-M-53596-2024 is reproduced herein-under:
"By way of filing the instant application, the applicant/petitioner seeks preponement of the main case, which is presently fixed for 14.1.2025. Learned counsel representing the applicant/petitioner submitted that as a matter of fact the applicant/petitioner wishes to withdraw the main case so as to surrender before the Trial Court and to move an application for grant of regular bail and that the main case may be preponed. In view of the specific prayer made by learned counsel for the applicant/petitioner for withdrawal of the main case and in view of the reasons mentioned in the instant application, the same is allowed and the main case i.e. CRM-M-53596-2024, which is presently fixed for 14.1.2025 is preponed and is taken on board today and the main case itself is hereby dismissed as withdrawn.

CRWP-60961-2024 (O&M) ( 2 ) Needless to mention, in case the petitioner surrenders before the trial Court within a period of one week from today and applies for grant of regular bail, the learned trial Court shall endeavour to dispose of the same expeditiously."

The case of the prosecution, in nutshell, is that on 6.8.2024 co-accused Rohtash was apprehended by the police, who was found in possession of 5.386 grams of 'heroin'. During the course of interrogation, he had disclosed that he had purchased the said contraband from the petitioner Ravinder @ Ravi.

Learned State counsel informed that the petitioner happens to be involved in one more case under Narcotic Drugs and Psychotropic Substances Act, wherein the petitioner infact had been granted interim anticipatory bail, but he did not even chose to join investigation. It has further been informed that during the course of investigation, the police has been able to lay hands on some conversation between the petitioner and co-accused, which clearly reflected on the complicity of the petitioner. 4.
Having regard to the aforestated position, this Court does not find any special case for grant of anticipatory bail.
