The present petition has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking interim bail to the petitioner in case bearing FIR No.522 dated 19.10.2023 under Sections 22(C)/29 of the NDPS Act registered at Police Station City Bhiwani, District Bhiwani, Haryana. 2.

Learned counsel for the petitioner has submitted that the petitioner's wife is suffering from 3rd stage cancer and is taking treatment from the Department of Medical Oncology NCI, All India Institute of Medical Sciences, New Delhi. Further, she has to undergo chemotherapy at regular intervals and his minor daughter namely-Yashika is also suffering from medical problem and there is no other member in his family to arrange the funds and support them and to take them for medical treatment. Learned State counsel has filed custody certificate in Court today, which is taken on record and opposed the grant of any relief to the petitioner. However, she could not controvert the facts that the petitioner's wife is undergoing oral chemotherapy.

Keeping in view the health condition of the wife of the petitioner, the present petition is allowed and the petitioner is ordered to be released on interim bail for a period of 30 days from 13.11.2025, on his furnishing bail bonds/surety bonds to the satisfaction of Illaqa Magistrate/Trial Court. The petitioner is directed to surrender before the jail authorities on 12.12.2025 by 05:00 P.M.
