PANKAJ JAIN, J. (Oral) On 23.01.2024 the following order was passed:- "

Custody certificate has been filed. The same is taken on record.

Learned counsel for the petitioner submits that in order to show his bona-fide the petitioner is ready to pay back Rs.5.00 lakhs by way of demand draft in the name of the complainant which he is alleged to have received by signing the receipt.

The aforesaid offer made by the counsel for the petitioner has been accepted by the counsel for the complainant. In view thereof, the petitioner is ordered to be released on interim bail subject to the satisfaction of the concerned CJM/Duty Magistrate.

The petitioner may bring demand draft in the name of the complainant on the date fixed as undertook by him through his counsel.

Adjourned to 01.02.2024"

CRM-M-65341 of 2023 -22024:PHHC:014506 In compliance of the order dated 23.01.2024 the counsel for the petitioner has produced demand draft dated 31.01.2024 amounting to Rs.5,00,000/- in the name of the complainant. The same has been handed over to Mr. Ritesh Tomar, Advocate for the complainant, who has accepted the same. Copy of the demand draft is taken on record.

In view of above, interim order dated 23.01.2024 passed by this Court is made absolute.

Needless to say, tendering of the amount shall not prejudice the rights of the petitioner during the court of trial. 4.
