The limited prayer in the present petition is for issuance of a direction to the Trial Court to decide the application filed by the plaintiffpetitioner under Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908 (CPC) expeditiously.

Learned counsel for the plaintiff-petitioner would contend that the suit was filed in the year 2022 and the application under Order 39 Rules 1 and 2 CPC also was filed along with the said suit which has been pending consideration since then. Learned counsel for the plaintiff-petitioner limits his prayer and states that he would be satisfied if the Trial Court is directed to expedite the hearing of the application under Order 39 Rules 1 and 2 CPC. In view of the limited prayer made by the learned counsel for the plaintiff-petitioner the present petition is disposed off with a request to the Trial Court to expedite the hearing of the application under Order 39 Rules 1 and 2 CPC, in accordance with law.
