***** ARCHANA PURI, J. (Oral) As observed in the previous order, despite service, respondent had not made appearance. Even today, there is no representation on behalf of the respondent. As such, the respondent is hereby proceeded against ex parte.

Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13(ia) of the Hindu Marriage Act i.e. DMC/147/2025, titled 'Neeraj Vs. Neetu Kumari', filed by the respondent-

husband, pending in the Family Court, Sonepat and she seeks transfer of the same to the Court of competent jurisdiction at Charkhi Dadri. It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 29.06.2021. Two children, born from the said wedlock, who are in the age group of 2 to 5 years, are in the care and custody of the applicant. The applicant is not having any source of earning and is dependent upon her parental family. She has filed petition under Section 144 of Bhartiya Nagarik Suraksha Sanhita, as well as petition under Section 12 of Protection of Women from Domestic Violence Act, which are pending in the Courts at Charkhi Dadri and the respondent is making appearance in both the said petitions. The distance between the two places is stated to be 130 kilometres.

In view of the submissions aforesaid, more particularly, considering the applicant, to be taking care of two minor children, though, she herself has no source of earning and also, the fact of other two litigation, already pending in the Courts are Charkhi Dardi, which are pursued by the respondent and above it, considering the fact of respondent not having come forward to resist the transfer application, the same is allowed and the petition under Section 13(ia) of the Hindu Marriage Act i.e. DMC/147/2025, titled 'Neeraj Vs. Neetu Kumari', filed by the respondent-husband, stands transferred from the Family Court, Sonepat, to the Court of competent jurisdiction at Charkhi Dadri. The requisite record of the aforesaid case be sent by the Family Court, Sonepat, to the District and Sessions Judge, Charkhi Dadri.

Learned District and Sessions Judge, Charkhi Dadri, shall assign the said petition to the Family Court, Charkhi Dadri. Even, the parties are directed to appear before the Family Court, Charkhi Dadri, within a period of one month from today onwards.
