The applicants have filed the present application for seeking transfer of the petition under Section 7 and 25 of the Hindu Minority and Guardianship Act, filed by respondent, bearing No.HMGA-1-2024, titled 'Paramjeet Kaur vs. Harpreet Kaur and another', pending in the Family Court, Jind and they seek transfer of the same to the Court of competent jurisdiction at Patiala.
In pursuance of the notice issued, the respondent made appearance through counsel.
At this stage, counsel for the respondent submits that he does not want to file any reply and has no objection, if the transfer application is VINEET GULATI 2026.02.12 16:24 I attest to the accuracy and authenticity of this document Chandigarh
TA-1373-2025 -2accepted, as the child in question is residing at Patiala and the petition under Section 7 and 25 of the Hindu Minority and Guardianship Act, for the custody of the child has been filed at Jind, the place where the parental grand-mother i.e. respondent is residing.
Keeping in view the statement so made by counsel for the respondent and also taking into consideration the place where the child is residing, the transfer application, as such, is hereby allowed and the petition under Section 7 and 25 of the Hindu Minority and Guardianship Act, filed by respondent, bearing No.HMGA-1-2024, titled 'Paramjeet Kaur vs. Harpreet Kaur and another', stands transferred from the Family Court, Jind, to the Court of competent jurisdiction at Patiala. The requisite record of the aforesaid case be sent by the Family Court, Jind to the District and Sessions Judge, Patiala.
Learned District and Sessions Judge, Patiala shall assign the said petition to the Family Court, Patiala. Even, the parties are directed to appear before the Family Court, Patiala, within a period of one month from today onwards.
