Dated Police Station Under Section/s 20.7.2024 City Barnala, District Barnala, Punjab 21 of Narcotic Drugs and Psychotropic Substances Act, 1985, wherein offence under Section 29 of NDPS Act was added later on GURVINDER SINGH GILL, J. (Oral) 1.

The petitioner seeks grant of regular bail in respect of the aforementioned FIR.

The allegations, in nutshell, are that 8 bottles of 'Wincerex Cough Syrup' containing 'Codenie Phosphate' were recovered from the petitioner. 3.

Learned counsel for the petitioner submits that admittedly it is a case of recovery of 'non-commercial' quantity of contraband and since the petitioner has already been behind bars since the last about 4 months and 17 days, he deserves to be released on bail.

Opposing the petition, learned State counsel submitted that since the petitioner stands convicted in two other cases of recovery of 'nonPankaj Kakkar 2024.12.10 17:35 I attest to the accuracy and authenticity of this document

CRM-M-61073-2024 (O&M) ( 2 ) commercial' quantity of contraband, it is evident that the petitioner is a seasoned criminal. Learned State counsel has, however, informed that the petitioner as on date has been behind bars since the last about 4 months and 17 days and that challan already stands presented. 5.

This Court has considered rival submissions addressed before this Court. 6.

Without commenting anything as regards merits of the case, but having regard to the fact that it is a case of recovery of 'non-commercial' quantity of contraband, wherein the petitioner has been behind bars since the last about 4 months and 17 days, further detention of the petitioner will not serve any useful purpose.

The instant petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
