***** ARCHANA PURI, J. (Oral) As per the observations made in the order dated 06.03.2026, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte.

Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/42/2025, titled 'Kamaljeet Singh Vs. Mandeep Kaur', filed by the respondent-husband, pending in the Family Court, Jalandhar and she seeks

transfer of the same to the Court of competent jurisdiction at Samana, District Patiala.

It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 25.02.2021. Two children born from the said wedlock, who are in the age group of 2-5 years, are in the care and custody of the applicant. The applicant is not having any source of earning. On account of this estranged marriage, the applicant has filed the civil suit for maintenance, which is pending in the Courts at Samana. Besides the same, she has also filed a suit for declaration and permanent injunction i.e. CS/498/2025, which is also pending in the Courts at Samana. The respondent is making appearance in both the said cases. The duration of travel between the two places is stated to be about 5 hours.

Keeping in view the submissions aforesaid, more particularly, considering about the applicant to be taking care of two minor children, who require constant care and attention of the mother; also about the applicant, not having any source of earning; fact of two other cases, arising from the broken status of marriage, to be already pending at Samana and above it, considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/42/2025, titled 'Kamaljeet Singh Vs. Mandeep Kaur', filed by the respondent-husband, stands transferred from the Family Court, Jalandhar, to the Court of competent jurisdiction at Samana, District Patiala.

The requisite record of the aforesaid case be sent by the Family Court, Jalandhar, to the District and Sessions Judge, Patiala.

Learned District and Sessions Judge, Patiala, shall assign the said petition to the Family Court (Camp Court) Samana. Even, the parties are directed to appear before the Family Court (Camp Court) Samana, within a period of one month from today onwards.
