Learned counsel for the petitioner submits that though the present present has been rendered infructuous on account of the fact that his custody is no longer required, since the prosecution complaint stands filed on 14.07.2025, however, the impugned order is in teeth of the judgments in Union of India vs. Padam Narain Agarwal and Others, (2008) 13 SCC 305 vs. Vijay Kumar Gopal Chand Ram Chandani vs. Amar Sadhuram Mulchandani and Others, 2022 SCC OnLine SC 1861.
