0 As per the allegations, the aforementioned FIR was registered on the basis of statement recorded by complainant Sajan alleging therein that on 02.10.2024, the petitioners along with coaccused had assaulted father of the complainant namely Sat Pal and had also caused injuries to the complainant by respective weapons which they were carrying. Apprehending their arrest, the petitioners had moved an application for grant of anticipatory bail which has been dismissed by Court of learned Sessions Judge, Gurdaspur vide order dated 26.11.2024.
It is argued by learned counsel for the petitioners that they have been falsely implicated in this case. There is delay of 29 days in lodging of the FIR which has remained unexplained. It is a case of version and cross version and infact the complainant party was aggressor party. They are ready to join the investigation. Their custodial interrogation is not required. Above said offences are bailable in nature except offence under Section 333 of IPC. No recovery is to be effected from them. Therefore, the petition deserves to be allowed.
