Through instant petition filed u/s 528 of BNSS, 2023, petitioners are seeking quashing of FIR No.99, dated 12.11.2016, u/s 36 of the Punjab Apartment and Property Regulation Act, 1995 (PAPRA Act), registered at P.S. Koom Kalan, Distt. Ludhiana (Annexure P-), challan dated 20.09.2018 (Annexure P-2) and order of charge dated 18.05.2019 (Annexure P-3), passed by learned JMIC, Ludhiana, whereby, petitioners have been charged u/s 36 of the PAPRA Act, 1995, along with all consequential proceedings arising therefrom.

Admittedly, no application for compounding of offences, based on the plea now taken before this Court, was moved by the petitioner before the Court which dealt with the trial. Charges were framed on 18th May, 2019 (P-3).

Faced with the situation, counsel prays for withdrawal of present petition with liberty to move an appropriate application before the trial Court, in accordance with law.
