   # 2+3+*#*#. 0        4 5/ 6Petitioner, an accused in case FIR No.189 dated 26.08.2025 registered against him, for commission of offences punishable under Sections 420, 120-B IPC at Police Station Maqboolpura, District Amritsar, has prayed for grant of pre-arrest bail.

Learned counsel submits that the petitioner is only an attesting witness to the sale deed, executed on the strength of alleged forged/fabricated GPA. Further, learned counsel submits that petitioner had no knowledge that the GPA is forged and is not beneficiary of transaction. Moreover, the case is entirely based on the documents and nothing is recovered from the possession of petitioner. Learned counsel further submits that petitioner is willing to join the investigation as and when called for by the IO. Notice of motion.

Mr. Jatinder Pal Singh, Sr. DAG, Punjab, accepts notice on behalf of respondent-State and seeks time to file detailed status report.

Mr. Mikhail Kad, Advocate has filed his power of attorney on behalf of the complainant, which is taken on record. Learned counsel for the complainant opposes the request for grant of pre-arrest bail on the ground that petitioner was fully aware of the fact that GPA is forged and MOHIT 2026.03.09 16:54 I attest to the accuracy and integrity of this document

In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.). 7 8
