Advocate General, Haryana. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner has filed this petition for grant of regular bail in case FIR No. 381 dated 27.07.2024 under Sections 115, 118(1), 118(2), 190, 191(2) 191(3), 351(2) of Bharatiya Nyaya Sanhita-2023 registered at Police Station Dabwali Sadar, District Dabwali (Sirsa). 2.

The petitioner is in custody since 10.08.2024. Challan in the present FIR has been filed on 28.10.2024. Though there is a criminal antecedent against the petitioner but the same is a minor offence which can be ignored. More so, the co-accused Kulwinder Singh alias Makhan has already been granted regular bail by this Court vide order dated 27.11.2024 (Annexure P-3).

In view of the above facts and circumstances, this Court extends the benefit of regular bail to the petitioner subject to his furnishing personal bonds for a sum of Rs.50000/- with two sureties of the like amount each to the satisfaction of trial Court/Duty Magistrate. It is made clear that the observations made herein shall not be construed to be an expression of opinion on the merits of the case. 5.

This order shall also remain subject to the following condition:- i) The petitioner shall plant 10 saplings of indigenous plants at a public place and submit proof in that regard by way of photographs before the concerned trial Court within a period of 15 days and if there is no such intimation submitted or intimation is found to be incorrect, then the State can move an application for cancellation of his bail.

The petition stands allowed.
